LOCAL 764 UPDATE WEDNESDAY MARCH 24TH 2021

At the Local 764 Membership Meeting on Sunday, March 21st the Membership paused for a moment of silence for the Asian Pacific American women workers killed by gun violence in Atlanta.  Pat White read the statement below, and the membership unanimously voted to donate to the Asian American Legal Defense and Education Fund, as motioned by Debra Katz Weber.  You can learn more about this organization here: https://www.aaldef.org/

Local 764 strongly condemns the fatal attack earlier this week in Georgia on the mostly female workers of Asian Pacific descent.  Our solidarity goes out to the families and loved ones.  Racist, xenophobic and hate-fueled actions and attacks have no place in our society, and as citizens we must be allies to all who are subjected to such violence: physical, verbal, or emotional.

As a Union, we recognize that workplaces, especially, should be places where workers feel safe.  It is the right of all people to be safe, respected, seen and protected.  Until this is true for all of us, none of us are truly free.

Local 764 Constitution and Purpose:

As announced at the March 22nd Local 764 Membership Meeting, the New Local 764 Constitution passed with an overwhelming majority.

The Redline (edited) version of the Constitution is on the Members’ section of the Local 764 website (www.ia764.org), and as soon as the final proof is done the finished copy will be available to all members.

Below is our new language stating Local 764’s Purpose:

ARTICLE II: DECLARATION OF SOLIDARITY

SECTION 1: PURPOSE

This Local is dedicated to the principles of trade unionism. Its objects are to unite all workers within its jurisdiction for the following purposes:

  1. To improve the wages and hours of work, to increase their job security and to better their working conditions.
  2. To advance their economic, social, and cultural interests.
  3. To establish peaceful and harmonious relations between its members and their employers, and to increase the stability of the industry.
  4. To assure full employment.
  5. To promote and support democracy and free trade unionism.
  6. To engage in such other activities as may be necessary or proper to strengthen the labor movement and to extend the process of collective bargaining throughout all trades and industries. This Local shall endeavor to accomplish the foregoing purposes by organizing the unorganized, educating its membership, negotiating collective bargaining agreements with employers, securing progressive legislation, and by all other appropriate means within the International.

SECTION 2: DIVERSITY, EQUALITY, AND INCLUSION

  1. The Union recognizes the value of diversity in the workplace and commits to working with members and employers toward achieving work environments that reflect a diverse workforce.  Local 764 opposes employment discrimination or harassment based on race, color, religion, sex, pregnancy, gender identity, gender expression, sexual orientation, national origin, disability, age, status of a parent, marital status, veteran status and genetic information. Every member is entitled to equal opportunity to work in a discrimination free and harassment free work environment.  

2. If a member is proven guilty of discrimination and/or harassment after a trial as per Article IX of the Constitution (Discipline of Members and Impeachment of Officers), the offending member will be subject to penalty(ies) in accordance with the Article IX of the Constitution based on the severity of the offense.

New York Pop Ups

As discussed at the March 764 February Membership Meeting:

Local 764 has reached an agreement to cover the NY Pops Up Festival, which can be found in the members section of the website under the heading “contracts”. This festival, which includes many different kind of events, will run through Labor Day. Please note, these events are separate from New York City’s “Open Culture” permitting program. Protect NY Arts Workers

Local 764, along with the Coalition of Broadway Unions and Guilds (COBUG) has written to New York State Representatives for their support of our workers.

You can help support and protect New York Arts Workers by making sure that any funding provided by the state includes Protections for Collective Bargaining Agreements and Prioritizes Workers!

LOCAL 764 ELECTIONS: Nominations April 22nd

As discussed at the February and March Local 764 Membership Meeting:

Nominations Procedure for the Local 764 2021 Elections

 As previously announced, Local 764 will have nominations for the offices of Secretary/Treasurer, four Trustees and Convention Delegates at the Regular Membership Meeting scheduled for Thursday April 22nd at 2:30 pm.  Due to the COVID-19 crisis and restrictions that are still in place, this meeting may be help held through the online platform GoToMeeting.
Nominations for all offices will be conducted as per Article IV, Section 5 of Local 764’s Constitution and By-Laws (available to members in the members section of the Local 764 website) with certain modifications necessary to accommodate the online platform process should it be necessary: 

To be eligible for office, a person must have been a member in good standing for a period of not less than two years and must have attended at least four regular membership meetings within that two-year period. Both regular, in-person membership meetings and virtual membership meetings are considered in this calculation.   A member wishing to apply for a waiver of the meeting requirement must make a written request to the Executive Board at least ONE HOUR (1:30 pm) before the 2:30 April 2021 Meeting.

This request may be mailed to the Local 764 office at 545 W 45th Street, 2nd Floor New York, NY 10036 or emailed to David Erdei at [email protected].  It is recommended that those considering candidacy check their meeting attendance with David Erdei in advance if they have any doubts.
Members wishing to nominate a candidate for office must be in good standing. To place a name in nomination, it shall take a sponsor and a second, neither of which may be the nominee in question.

Any member may make a nomination or a second either by email prior to the 2:30 pm April 22nd meeting, or at the meeting. Email nominations should be sent to the Local 764 office by emailing David Erdei at [email protected].  Nomination emails should state the name of the member you would like to nominate, and the office for which you are nominating that member.  Emails must be received by the Local 764 Office by or prior to 2:30 pm April 2021 Membership Meeting.
Real time nominations may also be made. If the meeting is conducted through the online platform GoToMeeting members who register and attend the Member Online Meeting on April 22nd, 2021 at 2:30 pm may nominate candidates in real time, during the meeting.  Members may either speak or use the “chat” function in the platform.  For more information on how to use these features, please contact the Secretary/Treasurer at [email protected].  

Nominations shall take place for the following offices:
Secretary/Treasurer
Four Trustees
Delegates to the IATSE Quadrennial Convention to be held virtually during the week of July 25, 2021. (Local 764 expects to have between 12 and 14 open seats.)

A member wishing to accept a nomination who will not be present at the meeting may file an acceptance in writing (email is fine) to the President at [email protected] by or prior to 2:30 pm on April 22nd, 2021.  Members filing an acceptance in writing must indicate the office they wish to accept.

Please note: As per Local 764’s Constitution, nominees must have both a sponsor and a second, and may not nominate themselves.  No member shall accept nomination for more than one office.

Electioneering: Immediately following the nominations, each candidate will be given an opportunity to address the membership.  Nominees may do so on the online platform if used or may send a statement to be read by another member of their choice, or the President.  If another member or the President read the statement, they must read the exact copy as submitted by the candidate and not change, correct and/or editorialize.
Candidates may submit a biography or statement of no more than 250 words to be included with the ballot.  Statements must be submitted to the Election Board by 9:00 am Monday, April 26th, 2020. 
All subsequent elements of the election will be conducted in strict accordance with the Local 764 Constitution, which may be found on the Local 764 website. Ballots will be mailed out during the week following the nominations, and the announcement of those elected will happen at the May Regular Membership Meeting.

Request a Job Site Visit Online

Due to COVID-19, Local 764 Business Representatives must comply with individual production testing requirements when visiting members on their jobs sites. To facilitate this, Local 764 has set up a regular testing schedule for its Business Representatives.

In answer to requests by members, an online sign up form has been created to help members schedule routine visits during COVID-19 on the Members’ section of the Local 764 website.  You can find this request for under the “Job Site Visits” tab on the Main Menu.

Routine visits can be set up for Mondays and Thursdays.

The purpose of this form is to facilitate routine visits only.  If you need a Representative to visit in an emergency, or have an immediate need on set, please contact a Local 764 Business Representative directly:

Both Local 8 of the IATSE and the IATSE International have open opportunities for  Local 764 members to take Online OSHA 10 Classes.

Local 764 Wally Hall Fund

Members in good standing may take a loan of up to $3000.00 from the Local 764 Wally Hall Emergency Fund.  These loans are interest free for 18 months.  Please contact Julie Fernandez at [email protected] for more information.

Actors Fund Local 764 has a Members Assistance Program that is administered by the Actors Fund.  Members should contact [email protected] for the social service resources provided through the 764 Membership Assistance Program.
